§ 1     Services, prices, payment

1. The accommodation contract becomes valid upon receipt of the deposit on the bank account of TORREVISTA - L’Antica Pieve SRL. Basis of the contract is the booking confirmation sent by TORREVISTA - L'Antica Pieve SRL. The guest who undertakes the booking is liable as principal for all guest-side obligations arising from this contract in their entirety.
   For bookings not made directly through TORREVISTA - L'Antica Pieve SRL or through the booking service provider Quovai via the internet site www.torrevista.it, but through external service providers such as Booking.com, airbnb.com or others, the booking conditions published there at the time of booking apply.
   The guest is obliged to check the booking confirmation for accuracy. If the content of the booking confirmation differs from the booking request and the guest does not object to this immediately, the content of the booking confirmation shall be deemed to be contractually agreed.
   At the time of booking, TORREVISTA - L'Antica Pieve may require the guest to provide credit card details to confirm/guarantee the reservation. If a deposit of the rental amount is asked by the property, this deposit is due for payment at the point of time stated in the booking confirmation. Payment of the balance is due at the time of arrival. If the payment deadlines are not met, TORREVISTA - L’Antica Pieve SRL may withdraw from the contract. Non-payment is considered a withdrawal by the client and entitles the property to re-rent the accommodation.

2. The guest is obliged to provide truthful information about the number of persons who will occupy the apartment. The occupancy of the apartment is limited to the maximum number of persons specified in the description of the apartment. Occupancy with a number of persons exceeding this maximum number is possible only in the case of small children and requires the prior written consent of TORREVISTA - L'Antica Pieve SRL.

3. We will do our best to meet any special requests. However, their fulfilment is subject to the written confirmation by TORREVISTA - L’Antica Pieve SRL. For an extra charge, pets are welcome on request. Their type and size must be specified for this purpose.

4. The tourism tax (currently 1€ per person and day for persons over 14 years for max. 6 days), cleaning services as well as the costs for any extras/special requests will be charged on site and have to be paid in cash.

5. All prices include the applicable statutory value added tax.

 

§2     General rights and obligations, house rules

1. The guest has to treat the vacation apartment with due care, including inventory and outdoor facilities. If during damage occurs to the apartment and / or its inventory occurs during the rental period, the guest is obliged to immediately notify the administration. Defects and damages detected already upon arrival must be reported to the property management immediately, otherwise the guest shall be liable for these damages.

2. On the day of departure, the guest must remove all personal belongings, dispose of household waste in the collection containers provides, clean the dishes and put them in the kitchen cabinets, and empty the refrigerator.

3. TORREVISTA - L'Antica Pieve SRL is entitled to ask for a deposit of 300€ upon arrival. The deposit may be paid in cash or reserved on a credit card accepted by TORREVISTA - L'Antica Pieve SRL. TORREVISTA - L'Antica Pieve SRL will refund this deposit after the apartment has been vacated in due time and all keys have been returned, unless otherwise agreed with the guest, and provided that the apartment does not show any damage for which the guest is responsible. In the event that damage to the apartment and / or inventory is detected upon or after departure, the guest shall compensate TORREVISTA – L’Antica Pieve SRL for the damage.

4. The guest is obliged to respect the house rules of TORREVISTA - L'Antica Pieve SRL.

5. When bringing a pet, the guest must make sure that the pet does not urinate or defecate on the grounds or the immediate surroundings of the property. Pets are not allowed in the pool area.

6. There is a general ban on smoking inside the vacation apartment. Smoking is allowed in the outdoor area, except if this would disturb other guests.

 

§ 3     Withdrawal from the contract - cancellation

1. The guest can withdraw from the contract at any time. The withdrawal must be made in writing. The day of cancellation is the day of receipt of the cancellation letter by TORREVISTA - L'Antica Pieve SRL. In case of withdrawal, the guest is obliged to compensate TORREVISTA - L'Antica Pieve SRL for the damage incurred.
   Low and mid season:
   Until 14 days prior to arrival                               free cancellation

   Peak season:
   Until 30 days prior to arrival                               free cancellation

   Less than 1 day before arrival/no-show             100 % of the agreed price
   The guest has the right to provide a substitute person who will take his place in the contractual relation under the above conditions. Written notification with the name and contact details of the substitute person is sufficient.

2. Furthermore, TORREVISTA - L’Antica Pieve SRL is entitled to withdraw from the contract for an objectively justified reason, or to extraordinary termination of the contract, if for instance
   a) force majeure or other circumstances beyond the control of TORREVISTA - L'Antica Pieve SRL make it impossible to fulfill the contract,
   b) the vacation apartment was booked under misleading or false information of essential facts, e.g. regarding the identity of the guest(s), the purpose of the stay, or the occupancy or the accommodation of animals, as well as in case of repeated disregard of the house rules.
   TORREVISTA - L'Antica Pieve SRL shall immediately inform the guest of the exercise of the right of withdrawal or termination. In cases covered by paragraph 2a), TORREVISTA - L'Antica Pieve SRL shall immediately refund any payments and/or advance payments already made by the guest.
   In the case of justified withdrawal or justified cancellation by TORREVISTA - L'Antica Pieve SRL as covered by paragraph 2b), the guest has no right to compensation. The guest must compensate TORREVISTA - L'Antica Pieve SRL for all damages for which he/she is responsible in the event of withdrawal or extraordinary termination.

For bookings not made directly through TORREVISTA - L'Antica Pieve SRL or the booking service provider Quovai via the internet site www.torrevista.it, but through external service providers such as Booking.com, airbnb.com or others, the booking conditions published there at the time of booking apply.

 

§ 4     Special right of termination in the event of epidemics

If the guest’s country of residence proclaims a ban on travel to Montaione or a quarantine obligation for the guest after returning from Montaione for the time of the planned stay, the guest has the right to withdraw from the contract. The withdrawal must be made in writing. In this case, any deposits or payments made by the guest will be refunded except for an administrative fee of 100€.

 

§ 5     Arrival and departure, key handover, late eviction

1. As a rule, the apartment will be available to the guest as of 4:00 p.m. on the day of arrival. Arrival must be made by 7:00 p.m, unless a later arrival time has been expressly agreed in advance with TORREVISTA - L'Antica Pieve SRL or the property management. An arrival before 3:00 p.m. is also admissible only if this has been expressly agreed in advance with TORREVISTA - L'Antica Pieve SRL.

2. On the day of departure, the guest must vacate the apartment by 9:30 a.m. at the latest, unless a later departure time has been expressly agreed in advance with TORREVISTA -L'Antica Pieve SRL or the property management. If the guest vacates the apartment at a later time, TORREVISTA - L'Antica Pieve SRL is entitled to an additional payment (late departure fee) from the guest. This amounts to 50€ per full hour of delay. Furthermore, TORREVISTA  -L'Antica Pieve SRL is entitled to compensation for all additional damages incurred due to a delayed departure.

 

§ 6     final provisions

1. Changes or amendments to the contract, to the acceptance of the booking proposal or to these General Terms and Conditions shall be made in writing. Unilateral changes or additions by the guest are invalid.

2. The place of performance and payment is Montaione (FI), Italy. The place of jurisdiction is the court competent for Montaione (FI), Italy.

3. The contract is governed exclusively by Italian law.

4. Should any of the above provisions be or become invalid or void, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes as close as possible to the purposes of the provision to be replaced. In all other respects, the statutory provisions shall apply.
